Concordia University, based in Portland, Oregon, is continuing its efforts to establish a new law school in Boise, Idaho. Last month, the school reached an initial agreement to buy a 17,000 square foot facility that it plans to use for the project. Concordia plans to add an additional 30,000 square feet for law school use. These numbers suggest this will be a pretty small law school. That inevitably surfaces the question: can it break even? Former Idaho Supreme Court Justice Cathy Silak has been named dean for the school, which plans to open in the fall of 2011.
If you've been wondering why a Portland school thought it made sense to open a school in Idaho, the Concordia administration provides this helpful explanation:

Really. California farmers provide lots of food for the Drexel campus. Does that mean Drexel University can open up a campus there? Oh yeah. We did!
On a separate, but related, note, the University of Idaho hopes to begin offering third year classes in Boise starting this fall.
As a native of Boise this strikes me as a bad idea. I'm not sure if Boise needs a law school of its own at all. My impression from talking with people there is that the law job market is a bit tight (not as bad as some places, but not really booming) and there doesn't seem to be a shortage of lawyers, even though the "metro" area has grown a lot in the last few years. But, if a law school was needed in Boise, the obvious choice would seem to be to have it at BSU. BSU is an ambitious and growing school and I suspect they'd do a lot to support the school and make it viable. Why doesn't this happen? Because, under the state education rules, only the University of Idaho, up north in Moscow has the right to offer legal education (among the state schools, at least). Why not change the rule? Because U of I resents what they see as BSU "encroaching" on its territory(*), and its still the case that the plurality of state legislature members, if they went to college at all, went to U of I. It's a pretty dumb situation and one not explained by logic or economics. If this school starts I'd expect it to be, and remain, a pretty marginal law school.
(*) The fact that BSU has dominated U of I in football for 10 years or so also plays into this. I wish this were not so, but it certainly feeds the resentment.
