UCLA — The Backstory

She is “a Jewish student and very active in the Jewish community,” worried an elected member of the UCLA student government, as she prepared to vote against the nomination of Rachel Beyda to serve on the university’s Judicial Board.  Stunningly, three other members of the Undergraduate Student Association (USAC) voted the same way, expressing suspicions about the Jewish sophomore’s “divided loyalty” and doubting her ability to “maintain an unbiased view.” This story has been reported as an example of thoughtlessness and poor word choice, which was quickly remedied when the four delegates reversed their votes (due to the intervention of a faculty observer) and subsequently issued a letter of apology.  Unfortunately, there is much more to it than that.  The votes against Beyda were not cast in a vacuum.  Rather, they were the predictable upshot of a political situation at UCLA that has become increasingly hostile for many Jewish students.

For the past year, there has been a concerted effort at UCLA to rid the student government of anyone who might be insufficiently antagonistic toward Israel, which was seen as necessary to the passage of a BDS (boycott, divestment, sanctions) resolution.  And as it turns out, at least three of the four anti-Beyda voters have been closely connected to that campaign.  It is often said that the BDS movement is aimed only at Israel and not at Jews, but this incident shows just how easily anti-Zionism can give rise to what might be called Judeophobia – the assumption that Jews are politically suspect until proven otherwise.

In April 2014, Students for Justice in Palestine (SJP) brought a Judicial Board complaint against two USAC representatives, seeking to disqualify their votes on a divestment resolution because they had taken sponsored trips to Israel.  According to the SJP complaint, such travel to Israel constituted an improper “conflict of interest” that should have prohibited the two representatives from voting on a divestment resolution (which had failed to pass).  The Judicial Board, however, voted to reject the SJP petition, referring to it as “dangerously volatile” and holding, without dissent, that trips to Israel did not evidence a conflict of interest and that the two representatives’ votes against divestment had thus been “valid and legitimate.”

Notwithstanding that rebuff by the Judicial Board, SJP demanded that candidates in the next election to the USAC sign a pledge that they would not accept sponsored trips to Israel. At least two of the anti-Beyda voters signed that pledge, which also accused several Jewish organizations of Islamophobia and efforts to “marginalize multiple communities on campus.” 

Moreover, three of the four USAC representatives who voted against Beyda had run for office on the “Let’s Act” slate, which was endorsed in full by SJP.  Following their election, two of them sponsored an ultimately successful BDS resolution that was supported by an array of ethnic and religious student organizations.  Yet it was only when Beyda sought a position on the Judicial Council that “conflicts of interest” due solely to group membership suddenly became a burning issue.

Were the anti-Beyda voters simply misguided regarding conflicts of interest, or were their articulated concerns about her Jewishness indicative of something more troubling?  Was the initial attempt to deny Beyda a position on the Judicial Council linked to the no-voters’ pronounced antipathy toward Israel?  Were the objectors stacking the Judicial Council, wittingly or otherwise, by extending the same ban on non-BDSers that they had demanded on the USAC itself?  Regrettably, their tepid apology provides no comfort.  In a letter to the Daily Bruin, the four no-voters explained,

Our intentions were never to attack, insult or delegitimize the identity of an individual or people . . . and we are truly sorry for any words used during this meeting that suggested otherwise.

 But the problem was not the infelicity of their language, which was unambiguous.  After all, what alternative phrasing could have made the spurious objections to Beyda any more acceptable?  The apology for “words used,” rather than votes cast, shows just how much anti-Beyda voters had intended to deny someone “active in the Jewish community” a place on the Judicial Council, where the SJP petition had so recently been denied.

The conflation of Beyda’s Jewishness with “divided loyalty” is especially appalling, given that at least three of the four no-voters had campaigned for office on the basis of their own affiliations with religious or ethnic organizations. (I could not find campaign materials for the fourth.)  Two of them produced a joint campaign video in which they touted their leadership in the Muslim Students Association and the Iranian Student Group.  Another of the objectors circulated a flyer identifying himself as the president of the Sikh Students Association.  All of this would be unexceptional – indeed, quite admirable – if the same three students had not expressed such deep concern about Rachael Beyda’s membership in Hillel and a Jewish sorority.  In the world of the SJP endorsees, there is no impediment to campus office-holding by a Muslim, Iranian, or Sikh activist (nor should there ever be, of course), but the nomination of a self-identified Jewish student rang very loud alarm bells. What is the difference?

One searches in vain for a more benign explanation of the initial votes against confirming Rachel Beyda to the UCLA Judicial Council.  No doubts about her qualifications were ever raised during the forty minutes of discussion (video here), other than her Jewishness.  If the objectors did not, as they now insist, fall prey to Judeophobia, at least three of them seemed to have had a closely related political motive to vote against her. 

UCLA Chancellor Gene Block issued a statement criticizing the anti-Beyda vote, and he called the subsequent controversy a “teaching moment” about governance.  He actually praised the objectors for their pallid apology, while never once referring to anti-Semitism or politically motivated bigotry.  The anti-Beyda voters seem to think that all was made well when they retracted their words, and perhaps recognition of their own prejudices is too much to ask of undergraduates (which is why I have not named them).  But administrators should know better.  There is something foul afoot on the UCLA campus, and Chancellor Block and the other adults will not be able to deal with it unless they are willing to call it by name.

    Steve,

    Thank you for this powerful, timely, and incredibly important post. The antisemitism of the students' objections to Beyda's candidacy is undeniable. Even more deeply troubling and hypocritical than the students' overt stereotyping and two-facedness is Chancelor Block's unwillingness to call out the attack on Beyda because of her Jewishness. It is heart wrenching for me to see a growing acceptance of Jew hatred in the United States, even as it is again on the ascent in Europe.

    Legal academia in particular has a duty to speak out: don't hold your breath though.

    If this had been almost ANY other target, these pages would be full of self righteous indignation and outrage.

    What do we hear? Silence. Worse.

    Cue the haters. Let's hear the defenders: "Of course being a Jew and active in the Jewish community is suspect! We all know Jews can't be trusted to vote, as we vote, in a completely 'unbiased' manner."

    You gotta love legal academia for its consistency and ethical stance toward all persons.

    When it comes to purging people for their views on Israel, Israel's supporters' hands are not clean – and when it comes to make statements that link religion and ethnicity to political views, well again several of those even in this forum who post on this topic are pretty quick to make comments about muslims, Sikhs, Arabs and Palestinians – and when these are made, one or two of the outraged here are at least remarkably silent, unless indeed they just made them. And yes, I am thinking about Steven Lubet and Alexander Tsesis. Indeed the last time this issue came up there was an example of religious and ethnic commentary that linked being muslim, arab, Palestinian, Persian and Sikh with racism, and Steve – crickets chirped in your office.

    At UCLA, four students engaged in active discrimination — voting against someone because of their religion. At Oklahoma, a group of apparently racist frat brothers chanted hateful speech TO THEMSELVES, a protected (if distasteful) exercise of First Amendment rights. The students who discriminated against a Jew who was present at the time are excused; the ones who engaged only in speech against people who were not even there are immediately expelled.

    I've read your posts – and by the way the per se line, BS.

    The issue is pretty simple – and I'll put it in stark terms. I used to be anti-BDS – that was before Salaita and reading some of what you have to say. You managed to convert me to at least being ambivalent leaning perhaps pro – you personally, the things you said, the things Lubet said. Think about that for a minute – someone who was anti-BDS sees you and your conduct as a reason to possibly BDS. Ironic no?

    Why, because frankly if you and Lubet and the rest of your pals are going to lead efforts to ensure that anyone critical of Israel is reflexively called and anti-Semite and blocked from academic jobs, it seems to me that AIPAC and its supporters need a harsh taste of the same medicine. If you don't like that, well my heart bleeds for you. But if you want to sit spew attacks on people who criticise Israeli policies – which you do, you need to be ready to take the same lumps. Transparently you are not.

    Responding to Mack: I have not ever attacked people for criticizing Israeli policies, and I certainly have never advocated barring them from academic jobs. Regarding Salaita, I have repeatedly stated that it was wrong for the University of Illinois to withdraw his offer, and that his academic freedom was therefore violated.

    I have criticized some of Salaita's tweets as anti-Semitic, which I believe they were. This is not inconsistent. I believe in freedom of speech, even for people who say venomous things. It is the anti-Israel crowd that has attempted to soft-pedal Salaita as merely a critic of Israel, when his actual statements went far beyond that. Does his opposition to Israel make him above reproach? I think not.

    Beyond that, the idea of giving people "a harsh taste of the same medicine" is, well, out of place in a serious intellectual forum.

    Even more out of place is the idea that one cannot ever address anti-Semitism without simultaneously saying something critical of Jews, or Israel, or (gasp!) AIPAC. That is a rhetorical technique most frequently seen at Fox News. "I hate racism, BUT . . . ." "Police brutality is wrong, BUT . . . ." "No one wants ethnic profiling, BUT . . . ."

    I can easily endure any "lumps" that Mack cares to deliver, but let's keep the record straight on what has actually been happening.

    I'm going to make some points that Steve and Alex may not like – but tough.

    Organisations opposed to BDS are apparently providing free trips to Israel – all expenses paid, with in addition some spending money (according to the complaint $200.) The University has a conflict of interest policy that says that elected office holders should not engage in conflicts of interest. Here is the problem, it would seem to me that to accept a free trip worth thousands of dollars to Israel from an organisation interested in the way in which the two individuals would vote on USAC, given to them because of their role, is a conflict of interest. Steve evidently thinks that accepting these free trips was non-controversial – I wonder would he think the same about say Mecca, the West Bank or Tehran if sponsored by pro-Palestinian groups? You have a Judicial Board that seems to have recoiled from addressing the issue, which on its face, is a problem.

    Steve then is offended by the fact that SJP sought that those seeking election pledge not to accept free trips. Here Steve thinks it is controversial that the SJP would demand that free trips not be accepted from those who have an interest in the way a candidate votes. Again, I find this odd – that a group entitled Students for Justice in Palestine would ask that candidates for office agree not to accept the free trips would seem to me to be perfectly reasonable. Now if you were asking me if people who have already taken an open position on an issue like BDS or who are members of groups such as SJP or various loudly pro-Israeli groups should recuse themselves from Judicial Board of decisions on these matters – or if they should recuse themselves in the Judicial Board and student government when they have accepted a benefit from an interested party – here I would indeed see a point. And if pro-Israeli and pro-Palestinian groups organised themselves to such a level that their constant recusal would leave the Judicial Board or other body regularly un-quorate again I could see that to be a problem.

    But here Lubet is raising concerns over objections members of USAC taking free trips worth thousands of dollars from an interested party, suggesting (or at least broadly hinting) that the objection must be a result of antisemitism – and you know, I think it is a legitimate objection, and I'd say it if they were taking these trips from any interested party

    So I am very troubled by Steve's post here, because it seeks to couch objections to actions, accepting a benefit from an interested party, as automatically antisemitic.

These aren't "BDS" questions: these are the age-old memes of Jew hate the world over. Everybody knows it. Don't play us for fools.

    This thread is perfect proof of the problem.

    No matter how much they deny it, justifiers who perpetuate and support Jew hate always resort to a debate about Israel. As if proving Israel is evil (a perception often motivated by Jew hate, as the conduct provoking Israel is almost always ignored or quickly dismissed as irrelevant) proves that Jews are evil too.

    Don't take my word for it. Google the UCLA situation and read what is being said in the LA press.

    I stand corrected on Salaita – thank you Steve – your posts led me to believe that you agreed with his tenure being revoked.

    I have read Salaita's posts – I I certainly regarded some of them as intemperate and ill-judged. Do I think that proves him an anti-semite, no. I regularly also find Israel's defenders, particularly in the US to be intemperate, their comments ill-judges and regularly sliding over the line to outright racism and religious bigotry. I do regard AIPAC as an organisation that is seriously overreaching to the extent that it is endangering Israel's long term future.

    Personally – for various reasons I find the identification of religion with politics highly offensive (Netanyahu's claiming to speak for all jews was particularly outrageous – as many jews were quick to point out by the way.) I probably know more of he backstory of Netanyahu when he was ambassador in Washington DC, as foreign minster and in his first run as prime minister than is openly discussed – and Israelis, Europeans and people who dealt with him in DC are astonishingly hostile to him – tales of his mendacity abound.

    If Israel's supporters are going to push for people like Salaita (and other critics) to be effectively boycotted, they cannot with a straight face then demand that the same result not apply to them.

    You miss the big issue. Those who oppose Israel's policies have a big problem – some of those who oppose Israel (and its policies) do so for reasons that are openly antisemitic. However, surveys conducted in the US and UK pretty uniformly show that Jews are, in general, somewhat more critical of Israel's policies than the rest of the population – something that I find myself having to point out from time to time to critics of Israel.

    Antisemitism is a problem for those who oppose Israel's treatment of the Palestinians, who want a two state solution, etc. because it has two effects. First, it drives a "circle the wagons" reaction among Jews outside Israel, undermining the support that Palestinians might otherwise have from a social group that historically opposed racism and backed social justice; and (b) it makes it easier for people (like you) to argue that anyone opposed to Israel's policies must be a Jew-hater.

    To characterise those who object to Israeli policy as all Jew-haters is as bad as saying all Israel's supporter agreed with what Baruch Goldstein did at the Cave of the Patriarchs in Hebron – yes there are some extremists that think he is a hero, quite a few in fact, but most of Israel's supporters were completely disgusted and remain so, or to say that to be an Israel supporter means you agree with (the odious) Pamela Geller.

    If you know so much about Jews (you seem to claim to be an expert) perhaps you can help us understand the reasoning behind claims of "Worldwide Jewry" and charges of "divided loyalty" that preceded the State of Israel by centuries, and tell us whether the same charge, for the same reasons, in the present context must ALWAYS devolve into an effort by you and others to rant about Israel, and AIPAC, etc.

    I don't claim that every person who hates Israel hates all Jews (though, most do, because, as said above, they reveal THEIR bias by focusing only on the response by Israel and almost never on the provocations). Here, I claim that Jew hate exists, and that, if a person is refused admission to a board or other organization based on "[being] Jewish … and very active in the Jewish community,” then that is PRECISELY the sort of bigotry that so many would so vigorously condemn in another context.

    Instead, we need to endure lectures about Israel. What does that tell us?

    The falsehood isn't that Alex and Steve aren't "leaders" of these efforts — though of course, being affiliated with an organization (Ameinu) which is regularly critical of Israel, it is clear that they couldn't possibly be intolerant of criticism of Israel tout court (I'd add that I too have been critical of Israel and neither Steve nor Alex has ever accused me of being anti-Semitic, "reflexively" or otherwise). Rather, the obvious falsehood is that there exists any class of persons who engages in such an effort — who actually call "anyone critical of Israel" an anti-Semite. It should be clear upon a moment's reflection why no such people exist: Everybody who has thoughts on Israel is critical of it some of the time — the metric "critical of Israel doesn't distinguish" the JVP from ZOA. The difference is what is criticized — and when, why, and how. Calling *all* criticisms of Israel anti-Semitic would be a ridiculous position to take; presumably, ZOA doesn't think it's anti-Semitic when it criticized Israel for withdrawing from Gaza. Rather, ZOA, like Ameinu, and probably like the JVP, thinks that certain criticisms in certain contexts presented in certain ways are anti-Semitic (though they of course disagree substantively on which are good criticisms, which are bad, and which are outright anti-Semitic). And I may or may not agree with any individual judgment on that — but that's the terrain the debate has to fall on: Not "is all criticism of Israel anti-Semitic" (a position nobody forwards) but "is the particular criticism in question anti-Semitic." As articulated, Mack's contention barely rises to the level of "straw man."

    So why doesn't Mack just say what he means — that people call things anti-Semitic in circumstances where Mack disagrees? Presumably, the answer lies in the comparison between the false proposition he actually forwards and the true one which he actually means:

    (1) "Steve and Alex call anyone critical of Israel anti-Semitic."

    (2) "Steve and Alex call certain people critical of Israel anti-Semitic in cases where I disagree with that conclusion."

    The first statement suggests a serious deliberative failure on S&A's part. It posits that they are basically incapable of any sort of critical thought and suffer from a total failure of rationality. This would justify dismissing their arguments out of hand — if it was remotely possible that the premise was true. But it isn't. The second statement, by contrast, is clearly true but doesn't warrant the hyperbolic sky-is-falling-discourse-is-forever-doomed rhetoric Mack wants to deploy. Simply put, it is not a party foul for Steve or Alex or anyone else to argue that something is anti-Semitic when Mack thinks it isn't. And Mack knows this, which is why he isn't willing to characterize the debate on such mundane terms ("How dare people disagree with me when I adjudge a person innocent of anti-Semitism!"). Now Mack, same as all of us, certainly is entitled to argue against the specific judgments made by Steve or Alex or anyone on their merits. But he resolutely refuses to engage in that on-the-merits deliberation in favor of asserting the existence of a mass communal psychopathy amongst the mainstream Jewish community that renders them impossible to reason with. And, as I've argued in my "Playing with Cards" article, that's a form of bigotry regardless of whether the alleged "card" in question is "the anti-Semitism card", "the race card", or any other form of dismissing identity-based oppression.

    Here is a challenge – write a critique of Benyamin Netanyahu's speech in Congress of last week, discussion how he brought the divided loyalties issue into play (quite disgracefully I would add). It is not that difficult – a good few supporters of Israel, Jewish inter alia have done so. While you are at it, write a critique of his claim to speak for all jews.

    This is probably my final reply to Mack: It is not necessary for me to refute every comment with which I disagree, so your most recent criticism is foolish and tiresome. Anon did say above that most people who hate Israel also hate Jews. That is wrong, counterproductive, reductionist, and, in case I did not make myself clear, wrong.

    But so what? You continually rail at me for allegedly saying things that I never said, or for not saying things that you want me to say. None of that has any bearing on Judeophobia at UCLA, which is the point of the original post.

    Even then it contains an implicit distortion "most people who hate Israel also hate Jews." The inference is that those who criticise Israel's policies "hate Israel." However, I personally don't hate Israel – I object to some of its policies, but I think the state should exist (I may question how it was created.) Again, we end up with the implicit exaggeration.

    So I really don't care if you bother responding to me. But what I do care about is that you let people engage in what you now describe as counterproductive, reductionist, and wrong – that you were only spurred to respond when challenged, that you let loud defenders of Israel hurl this sort of crap, silently.

    To be absolutely blunt – I find anti-semitism odious – but I find the enthusiasm of so many of Israel's supporters for the casual slinging of the accusation also outrageous – and their silence while fellow travellers do it, while demanding other denounce antisemitism at every turn hypocritical to say the least.

    I am very glad to have pissed you off – try staying that way!

    Frankly I find your post disingenuous at best.

    There are few things as dangerous to any professional or academic as being labelled a racist and in particular an antisemite – cf Salaita. To suggest that the accusation is not flung around like "snuff at a wake" is to "pee down someones leg and tell them it's raining." The accusation is being flung far too casually, it is disgraceful – and pretending it is not does not address the issue.

    That those who tend to fling the accusation so easily are now defensive when the issue comes up … well, hmmm. Hasn't stopped them.

    To reiterate, this instance had nothing to do with Israel or the BDS movement, as stated above. As stated in the post, this issue concerned voting based on a person "being Jewish and active in the Jewish community." YOu quickly hijacked the thread and turned it into a debate about Israel. It is to that resort that I commented, as above. I am sort of doubting that you can't really understand the point here.

    As I noted above, Jew hate has for centuries relied, in material respects, on claims that Jews have "dual loyalty" and claims about "worldwide Jewry." These bases for Jew hate exist and have existed independently from views about Israel.

    As others pointed out, you have engaged in a terrible proclivity for simply inventing statements by others to knock down. That's cool for litigation; lots of litigators just misrepresent the position of their adversary and then hope for the best in court. Judges often read as carelessly as folks do here in the FL, and this tactic can be effective.

    But, it is sort of disappointing that you do this. I thought better of you.

    I'm not sure what it means to "fling" anti-Semitism accusations "casually." I imagine it involves doing it while sipping a Corona? If it refers to people calling things anti-Semitic when they don't actually believe that it is, then there's no proof regarding such cynical behavior. If it refers to people calling things anti-Semitic when Mack really doesn't think they are, then there's no reason to elevate Mack's instinctive reactions to the level of a deliberative rule. There's really nothing more complicated than that going on here: Mack thinks that people who disagree with him about what constitutes anti-Semitism are either lying or delusional, and should not be listened to. That's not actually a viable starting point for structuring a conversation.

    The conflation of religion with politics is fundamentally dangerous. The problem with that conflation is that it is driven from three directions.

    You have those who seek to conflate religion with criticism of a policy that is associated with member of that religion, as in jewish means automatically being a supporter or indeed responsible for Israel's policies "the Israelis did it, they are jewish, it's the fault of the Jews," i.e.- the antisemitic approach.

    Then you have those who try the "any true Englishman" approach, as in if you are Jewish you must support Israel, or if Irish you are a traitor if you don't support the IRA (I ran into that one on this forum from a someone the spam filter blocks commenting on.)

    Then you have those who advocates any position they disagree with means someone is a racist bigot (see anon above.)

    The problem with these gambits in argument is that they are not benign – they can get people killed. They certainly create a situation where all sensible debate is quashed. These gambits have come to be deployed in pretty well every debate about Israel, rendering the discussion a scorched wasteland where most people fear to tread. This is drive by people like anon – let's just read what he now wants to distance himself from:

    So to carefully parse what anon had to say, raising the question of whether it is appropriate for those opposed to BDS to be bringing those about to vote on the issue on expensive, fully paid excursions to Israel, amounts to a conflict of interest is "a lecture about Israel" that his non sequitur "what that does that tell us?" invites the answer anti-semite. [A]non obviously thinks those reading this tripe are idiots, or cannot remember what he said a few posts back.

    To put it more simply – I regard associating someone's religion with their political views- in general (I can make exceptions for lunatic religious extremism), odious. I also find associating someone's ethnicity with their politics toxic and outrageous. Do I think that critics of Israel do this – yes indeed, some do. Do all, far from it.

    Do I find it offensive that someone would require that to be a good "insert religion here" or " – insert ethnicity" you better agree with policy X or Y, or they have the right to speak for you. Absolutely.

    Do I think that the debate at UCLA has become toxic based on these standards – its toxicity is pretty damn obvious. Do I think that the supporters of Israel are innocent in its toxicity – no, I think they contributed, as did many of those supporters of the Palestinians. But trying to pretend that one side is Simon-pure or the other side wholly guilty is dishonest – it is part of what created the toxic discussion in the first place.

    And yes, I think throwing accusations of anti-semitism around casually have contributed to the mess. And those do I think anon is full of it … well obviously.

    I don't think the BDS advocates at UCLA should be expelled for their Jew hatred and their offensive conduct and remarks. I think the First Amendment protects hate speech and offensive speech. But I would be a lot happier if the UCLA Chancellor took the opportunity to denounce plain old fashioned Jew hatred like this. He should make clear that the BDS cause is vile and disgusting even if it is protected speech. His remarks, tailored carefully so as not to offend the leftists on campus, fell far short of what was required.

    Have you ever heard the expression "to act with good authority." The person who uses it most, indeed may have coined it, is a strong supporter of Israel. What does it mean – it means that you don't let people get away with things – you don't accept antisemitism, but you also don't accept the misuse of the accusation. And here we have a posting that says that all BDS supporters are vile and disgusting Jew-haters – and the sound of crickets chirping where those who were so exercised earlier now sit.

    From Durban to Los Angeles: the BDS movement’s long trail of anti-Semitism

    Last month, in a breathtaking display of anti-Semitism reminiscent of Nazi Germany, members of the student government at South Africa’s Durban University of Technology (DUT) called for the expulsion of all Jewish students from their campus. The very next day, halfway around the world, the student government at University of California, Los Angeles (UCLA) engaged in a similar display of anti-Jewish bigotry, nearly denying a highly qualified young woman a position on the student judiciary board after four student representatives brazenly argued that her Jewishness and affiliation with Jewish organizations should make her ineligible for the position.

    Besides a shared proclivity for anti-Jewish bigotry, the DUT and UCLA student governments have something else in common: both bodies had previously voted to embrace the Boycott, Divestment and Sanctions (BDS) movement against Israel. This is not a coincidence, but rather further evidence of the well-documented relationship between BDS and acts of anti-Semitism, particularly on college campuses. At schools where groups such as Students for Justice in Palestine (SJP) promote BDS, Jewish students have routinely reported being harassed, physically and verbally assaulted, threatened, vilified, and discriminated against. Jewish students’ property and the property of Jewish student organizations have been defaced, damaged, or destroyed, while Jewish student events have been disrupted and shut down.

    The link between BDS and anti-Semitism should come as no surprise to anyone who knows the history of the BDS movement, which ironically emerged at the 2001 U.N.-sponsored World Conference against Racism, Racial Discrimination, Xenophobia, and Related Intolerance—held in Durban, South Africa. Dubbed by former Canadian Minister of Justice and Attorney General Irwin Cotler as “the tipping point for the coalescence of a new, virulent, globalizing anti-Jewishness,” the Durban conference and its concomitant NGO Forum featured posters displaying Nazi icons, anti-Jewish cartoons, hecklers chanting “Jew, Jew, Jew,” and wide distribution of the virulently anti-Semitic “Protocols of the Elders of Zion” forgery. Tom Lantos, the late member of the U.S. Congress and Holocaust survivor, was part of the American delegation to the Durban conference and said the following: “For me, having experienced the horrors of the Holocaust firsthand, this was the most sickening and unabashed display of hate for Jews I have seen since the Nazi period.”

    BDS was spawned in the Durban conference’s fetid swamp of Jew-hatred and brought into the world through the NGO Forum’s Declaration of Principles, a document that not only laid the groundwork for the BDS movement, but also set the stage for today’s broader landscape of global anti-Israel activism. Written in highly politicized language, the Declaration of Principles declared Israel to be “a racist, apartheid state” and accused Israel of “crimes against humanity, including ethnic cleansing [and] acts of genocide.” According to the declaration, Israel should be punished for its “crimes” by “the launch[ing] of an international anti-Israel movement as implemented against South African Apartheid,” as well as “a policy of complete and total isolation of Israel as an apartheid state, which means the imposition of mandatory and comprehensive sanctions and embargoes, and the full cessation of all links (diplomatic, economic, social, aid, military operation and training) between all states and Israel.”

    If the BDS movement was born in 2001 at the Durban Conference and NGO Forum, it came of age in 2005 with the Palestinian Civil Society Call for BDS, which virtually all subsequent BDS campaigns—including anti-Israel divestment resolutions on U.S. campuses—have acknowledged as their source and guiding light. Although it was signed by more than 100 Palestinian NGOs, the main group behind the Palestinian Civil Society Call and the subsequent Palestinian BDS National Committee, which facilitates coordination of BDS campaigns worldwide, is the Council of National and Islamic Forces in Palestine. The council is a coalition of Palestinian political factions founded by Yasser Arafat at the start of the Second Intifada in 2000, for the purpose of opposing Israel and coordinating terror attacks against it. Not surprisingly, many of the council’s organizational members are linked to terrorism against Jews in Israel and worldwide. The council’s chief sponsors and major partners, the Palestinian Authority and the Palestine Liberation Organization, were recently indicted in a U.S. federal court for sponsoring terrorism, and at least three other organizations in the council are on the U.S. State Department’s list of Foreign Terrorist Organizations: Hamas, the Popular Front for the Liberation of Palestine (PFLP), and the PFLP General Command.

    Whether they have terrorist affiliations or not, all of the signatories to the 2005 Palestinian Civil Society Call for BDS—along with all of the groups that have established BDS campaigns in response to that call, including campus organizations like SJP—are committed to the elimination of Israel as a Jewish state and see BDS as an excellent means to that end. This is reflected in the demands of the Civil Society Call, particularly that Israel end “its occupation and colonization of all Arab lands” and permit all Palestinian refugees and their descendants “to return to their homes and properties.” The fulfillment of those demands would require Israel to commit territorial and demographic suicide. It is important to point out that denying Israel’s right to continue as a nation-state in which the Jewish people expresses its right to self-determination is a core element of the U.S. State Department’s definition of anti-Semitism.

    Those who monitor global anti-Semitism agree that the number and intensity of attacks against Jews worldwide are at levels not seen since the Holocaust. Given the BDS movement’s anti-Semitic nature, its clear ties to terrorist organizations committed to the destruction of Israel and the murder of Jews, and the anti-Semitic effects of the BDS movement on Jewish students, it is reasonable to ask: Why are BDS campaigns allowed on college campuses at all?

    The basic complaint is that various commentators have suggested that all supporters of BDS are antisemites, a lazy and offensive conflation. What, in your glorious brilliance do you do, double down.

    And by the way, intellectual honesty points to Alexander Tsesis for dodging the opportunity to say he disagrees with that thesis. He is outraged, so far….. Just so far….
